Apple Off The Hook In IPhone 'Glassgate' Class Suit

Law360, Los Angeles (August 25, 2011, 5:55 PM EDT) -- A California judge on Thursday threw out a putative class action alleging Apple Inc. broke state consumer protection and false advertising laws by overstating the durability of the glass on its flagship iPhone 4.

Judge Michael Johnson sustained Apple’s demurrer at a hearing Thursday, saying the consumer electronics giant’s public claims about the strength of the phone’s front-and-back glass panels should not have led plaintiff Donald LeBuhn to expect the phone would survive his daughter's dropping it 3 feet onto pavement while texting.
