Law360, New York (August 26, 2011, 12:26 PM ET) -- The Fourth Circuit on Thursday upheld class certification for a group of advertisers that allege the publishers of The Talking Phone Book telephone directories breached contractual obligations by misrepresenting the scope of their distribution coverage.
In a 2-1 decision, the Fourth Circuit rejected Hearst Communications Inc. and White Directory Holdings Carolina Inc.’s challenge to conditional certification of a class asserting breach of contract, breach of the implied covenant of good faith and fair dealing, and unfair and deceptive trade practices claims.
