Nuke Groups Ask DC Circ. To Halt Yucca Waste Fees

Law360, New York (August 26, 2011, 5:27 PM EDT) -- Several nuclear industry groups filed a petition Monday in the D.C. Circuit accusing the U.S. Department of Energy of unlawfully requiring power plants to pay $750 million annually for cleanup at the Yucca Mountain disposal site in Nevada despite plans to shut it down.

The government has allegedly not paid for construction at the controversial nuclear waste dump since 2010, and has not re-evaluated the fee it continues to charge nuclear plants for activity there, violating a requirement by the Nuclear Waste Policy Act of 1982,...
