Shrimp Exporters Object To Dumping Duty Calculation

Law360, New York (August 29, 2011, 7:56 PM EDT) -- Two Indian shrimp exporters lodged a complaint Friday in the U.S. Court of International Trade challenging a Department of Commerce anti-dumping duty review they say relied on unfair calculations.

Falcon Marine Exports Ltd. and Apex Exports allege Commerce improperly used zeroing to calculate dumping margins for setting duties on frozen warmwater shrimp from India.

The suit stems from the agency’s findings, issued in July, in which it assessed a 2.31 percent dumping margin against Apex and a 1.36 percent margin against Falcon following an administrative review...
