S. Africa Asks High Court To Review Its Antitrust Powers

Law360, New York (August 29, 2011, 6:24 PM EDT) -- South Africa's competition watchdog said Monday it had asked the country's highest court to review its case against an alleged fertilizer cartel, seeking its opinion on leeway the regulator is allowed when translating a third-party antitrust complaint into an official application for penalties.

The South African Competition Commission filed for leave to appeal the March dismissal of its case against Yara South Africa Pty Ltd. and Omnia Fertilizer Ltd. to the country's Constitutional Court, seeking to bypass the Supreme Court of Appeal.
