France Unveils Cookies, Data Breach Notification Law

Law360, New York (August 29, 2011, 7:19 PM EDT) -- The French Parliament on Thursday unveiled a new electronic communications law that requires website operators to obtain user consent for cookies and imposes data breach notification requirements on electronic communications service providers.

The new law, ordinance number 2011-1012, modifies the French Data Protection Act of 1978, the French Postal and Electronic Communications Code and the French Consumer Protection Code to comply with amendments to the European Union's 2002 e-privacy directive concerning the processing of personal data and the protection of privacy in the electronic communications sector....
