Mug Shots For Sale Could Incite Privacy Fights: Attys

Law360, New York (September 19, 2011, 6:58 PM ET) -- Entrepreneurs looking to capitalize on the growing availability of mug shots risk facing privacy litigation under right of publicity laws adopted by a number of states, even if they're not peddling celebrities' faces, lawyers say.

Law enforcement officials often deem mug shots public records, but their subjects could still sue individuals and businesses that use their images to make money without permission under right of publicity laws in 19 states, according to a website that tracks the laws, Rightofpublicity.com.
