Law360, New York (August 31, 2011, 4:37 PM ET) -- The Ninth Circuit on Tuesday granted Skadden Arps Slate Meagher & Flom LLP's motion for sanctions against the Alioto Law Firm for allegedly challenging the recent $1.4 billion merger between Southwest Airlines Co. and AirTran Holdings Inc. in order to win a cash settlement.
The appeals court referred the matter to the appellate commissioner to determine the amount of fees Alioto will be ordered to pay Skadden, counsel for Southwest and AirTran, for the excessive fees incurred by the last-minute challenge of the merger.
