Maytag Oven Explosion Class Action Stays Alive

Law360, New York (September 2, 2011, 2:03 PM EDT) -- A New York federal judge on Wednesday dismissed deceptive marketing allegations in a putative class action over a defective, explosion-prone oven, but kept alive other fraud claims against both oven manufacturer Maytag Corp. and appliance retailer Plesser's MSH Inc.

U.S. District Judge Arthur D. Spatt agreed with the defendants that several reports cited by the plaintiff as evidence that the defendants knowingly concealed the alleged defect could not support fraud claims because they were widely known and did not describe problems unique to Maytag's ovens.
