6th Circ. Revives Volunteer Fire Dept. Bias Suit

Law360, New York (September 02, 2011, 5:12 PM ET) -- The Sixth Circuit on Friday revived a sex bias suit brought by an administrative assistant and volunteer for an Ohio volunteer fire department, finding a lower court was too quick to rule that the department did not qualify as an employer.

The lower court should have considered all aspects of the volunteers' relationship with the department — and not just remuneration — when determining whether it was subject to the Civil Rights Act of 1964's anti-bias provisions, the Sixth Circuit ruled, reversing and remanding the decision....
