Acorda Loses Patent Fight Over Apotex’s Generic Zanaflex

Law360, New York (September 7, 2011, 12:59 PM EDT) -- A New Jersey federal judge ruled on Tuesday that Apotex Inc.'s proposed generic version of the muscle-relaxing drug Zanaflex did not infringe Acorda Therapeutics Inc.'s patent, and that the patent was invalid.

Acorda sued Apotex in October 2007 claiming that Apotex's generic product would infringe its patent, after the generic-drug maker filed an abbreviated new drug application with the U.S. Food and Drug Administration seeking permission to sell its own version of Zanaflex capsules.
