Judge Denies Class Cert. In Home Warranties Fight

Law360, New York (September 09, 2011, 1:51 PM ET) -- A California federal judge rejected a class certification bid Thursday in a homeowner's suit against First American Home Buyers Protection Corp., finding she failed to support allegations of a common scheme to encourage contractors to deny valid warranty claims and perform shoddy work.

Homeowner Emily Diaz's suit failed to support her theory of a common scheme to delegate claims adjustment to third-party contractors, or to provide evidence to counter First American's argument that the independent contractors do not deny claims, U.S. District Judge Marilyn Huff ruled....
