Countrywide Loan Fees Violated Mo. Law: 8th Circ.

Law360, New York (September 9, 2011, 5:42 PM EDT) -- The Eighth Circuit on Friday revived state claims against Countrywide Home Loans Inc. in a proposed class action filed by a Missouri couple over extra, unauthorized fees that were used to determine prepaid interest before they were eventually returned.

The published decision determined that Countrywide had violated the Missouri Second Mortgage Loan Act, claims under which the U.S. District Court for the Western District of Missouri had refused to consider for lack of standing because Jerry W. and Golda M. Washington were reimbursed for the fees....
