Energy Future Takes EPA Emissions Rule Feud To DC Circ.

Law360, New York (September 12, 2011, 4:13 PM EDT) -- Dallas-based Energy Future Holdings Corp.'s units petitioned the D.C. Circuit on Monday to review a U.S. Environmental Protection Agency mandate that Texas and 26 other states cut power plant emissions that travel across state lines.

The EPA's looming emissions requirements forced Luminant to idle two of its generating units and stop mining lignite at three mines at the expense of 500 jobs, according to the Energy Future unit, which filed the petition along with eight other affiliates.
