Law360, New York (September 13, 2011, 10:26 PM ET) -- The Ninth Circuit remanded Potrero Hills Landfill Inc.'s waste management lawsuit against Solano County, Calif., on Tuesday, finding that the case could continue in federal court without interfering with vital state interests.
A three-judge panel ruled that the Eastern District of California wrongly dismissed the case, which Potrero brought when environmental groups claimed the waste management company's landfill expansion project violated a 1984 county ordinance that limits the amount of waste that can be imported from other counties into Solano.
