Size Of Costco Shrimp Trays Fishy, Atty Tells 2nd Circ.

Law360, New York (September 14, 2011, 4:14 PM EDT) -- An attorney for a proposed class of consumers asked the Second Circuit on Wednesday to revive allegations that Costco Wholesale Corp. reaps as much as $40 million a year by skimping on the advertised amount of shrimp in party trays.

While a private party can't bring claims under the U.S. Food and Drug Administration labeling regulations at issue, prior cases have allowed consumers to bring state law damages claims for violations of federal labeling regulations, according to William R.
