Applied, Covidien Head To Trial Over Surgical Tool IP

Law360, New York (September 16, 2011, 4:37 PM EDT) -- A Texas federal judge on Thursday shot down Applied Medical Resources Corp.'s bid to toss claims related to two patents in an infringement suit brought by Covidien PLC over minimally invasive surgery devices, which will head to trial at the end of the month.

U.S. Magistrate Judge Keith F. Giblin denied Applied Medical’s motion for summary judgment on two of Covidien’s four patents at issue in the case, saying there are genuine issues of fact in dispute that remain to be tried.
