9th Circ. Revives Toyota Warranty Suit In Split Ruling

Law360, Chicago (September 20, 2011, 5:41 PM EDT) -- A split Ninth Circuit panel ruled Tuesday that courts are not robbed of subject matter jurisdiction in suits brought under the Magnusson-Moss Warranty Act when the plaintiffs fail to exhaust alternate dispute resolution procedures specified in the warranty at issue.
