Judge Won't Toss Fla. Antitrust Claims in LCD MDL

Law360, New York (September 21, 2011, 9:01 PM EDT) -- A California federal judge on Tuesday refused to toss Florida antitrust claims brought by indirect purchasers in liquid crystal display price-fixing multidistrict litigation, saying the claims were not time-barred because the defendants engaged in fraudulent concealment.

U.S. District Judge Susan Illston denied LCD panel makers’ motion to dismiss the plaintiffs' claims brought under Florida’s Deceptive and Unfair Trade Practices Act, finding the four-year statute of limitations was extended because the defendants fraudulently concealed their involvement in the alleged price-fixing scheme.
