Law360, New York (September 21, 2011, 5:07 PM ET) -- The Federal Circuit on Wednesday affirmed a lower court's $85,000 judgment against an Indiana farmer found to have infringed Monsanto Co.'s patents for Roundup Ready herbicide-resistant soybean seeds, rejecting his argument that the company's rights are exhausted.
The case against Vernon Bowman hinges on the restrictions Monsanto places on Roundup Ready seeds. Under the company's license agreement, growers who buy the seeds can only use them for one crop season and cannot use the progeny of the licensed seeds for planting.
