Supplement Maker Can't Disqualify Atty: Calif. Court

Law360, New York (September 21, 2011, 11:20 PM EDT) -- A California appeals court on Wednesday affirmed a decision denying Brain Research Labs LLC's motion to disqualify an opposing class counsel in a suit accusing the supplements maker of promoting an allegedly dangerous memory supplement.

The California Court of Appeal for the Fourth District said a trial court did not abuse its discretion when it denied Brain Research Labs' request to disqualify Thomas H. Clarke Jr. of Ropers Majeski Kohn & Bentley PC, who represents the putative class suing over memory supplement Procera AVH.
