Time Expired On Bayer Blast Wrongful Death Claim: Judge

Law360, New York (September 27, 2011, 1:27 PM ET) -- A West Virginia federal judge on Monday nixed the final claim in litigation against Bayer CropScience LP over a 2008 chemical plant explosion and its now-abandoned plans to restart methyl isocyanate production there, saying a wrongful death claim was time-barred.

U.S. District Judge Judge Joseph R. Goodwin granted summary judgment to Bayer on Warne Ferguson's claim over the death of his wife, Gail Marie Ferguson, whose health was allegedly damaged by the explosion at the chemical facility and the intense fire that it sparked.
