Drinks Co. Can’t Nix Class In Suit Over NM False Ads

Law360, New York (September 27, 2011, 6:56 PM ET) -- A California federal judge on Tuesday turned down Blue Sky Natural Beverage Co.'s request to dissolve a nationwide class of Blue Sky customers accusing the company of falsely advertising that its drinks came from Sante Fe, N.M.

The lawsuit claims the seller of natural sodas, fruit juices and energy sport drinks continued to suggest its drinks originated in Sante Fe until May 2006 — long after Blue Sky moved to California in 2000 following defendant Hansen Beverage Co.'s acquisition of the company.
