Oregon Court Says Workers Can Sue Over Breaks

Law360, New York (June 20, 2007, 12:00 AM EDT) -- An Oregon state court of appeals has granted employees wages for breaks they had not been allowed to take, effectively recognizing workers' right to sue employers for denying them breaks.

The plaintiffs in the case sued their employer, Legacy Good Samaritan Hospital and Medical Center, for failing to provide them with paid lunch and rest breaks. They argued that they should be paid back wages for the breaks they should have been allowed, along with additional penalty wages.
