CBS Cleanup Case Hinges On Bankruptcy Ruling: Judge

Law360, New York (September 29, 2011, 4:54 PM EDT) -- A federal judge on Wednesday denied CBS Corp.'s bid to toss a suit over environmental cleanup at a Kansas waste management site, ruling that the case was too intertwined with an ongoing bankruptcy fight over the decadeslong contamination.

U.S. District Judge Kathryn H. Vratil rejected CBS' motions to dismiss Clean Harbors Environmental Services Inc.'s suit which seeks to force the network to resume cleanup at the Coffeyville, Kan., facility, where toxic chemical spills spawned a 1988 U.S. Environmental Protection Agency consent order.
