Toyota MDL Bellwether Belongs In State Court: Judge

Law360, New York (September 29, 2011, 7:37 PM ET) -- A California federal judge on Thursday threw out the first bellwether case against Toyota Motor Corp. in multidistrict litigation over alleged sudden accelerations in its cars, saying it belonged in Utah state court.

U.S. District Judge James Selna ruled that the plaintiffs — victims of a Toyota car crash blamed on acceleration defects — couldn’t meet a $50,000 damages threshold under the Magnuson-Moss Warranty Act that would allow their case to proceed in federal court.
