ITC Will Review Ruling For HTC In FlashPoint IP Case

Law360, San Diego (September 30, 2011, 3:43 PM EDT) -- The U.S. International Trade Commission said Friday that it plans to review part of a decision that smartphones made by Taiwan-based HTC Corp. did not violate FlashPoint Technology Inc.’s digital image manipulation patents.

The commission intends to examine now-retired Chief Administrative Law Judge Paul J. Luckern’s final initial determination that FlashPoint failed to demonstrate that HTC’s Android and Windows Phone 7 smartphones infringed U.S. Patent Number 6,262,769, but let stand his decision that HTC’s products did not violate U.S. Patent Number 6,136,816.
