Deschanel’s $1.5M Kohl's, Madden Shoe Fight Has Legs

Law360, Los Angeles (September 30, 2011, 4:51 PM EDT) -- A California judge on Friday tentatively ruled in favor of actress Zooey Deschanel in her fight with shoemaker Steve Madden Ltd. and Kohl's Department Stores Inc., indicating he would not toss claims accusing the companies of breaching a $1.5 million endorsement agreement and violating Deschanel's publicity rights.

Judge Abraham Kahn said there is a triable issue as to whether Steve Madden and Kohl's had Deschanel in mind when they manufactured, marketed and sold “Zooey” brand flats at the chain of retail stores.
