Software Makers Score As Top Court Denies Resale Suit

Law360, New York (October 03, 2011, 7:42 PM ET) -- The U.S. Supreme Court on Monday declined to weigh in on a Ninth Circuit ruling that allows software makers to prevent their customers from reselling used copies of their software under the terms of a licensing agreement.

In refusing to rehear the case, the high court preserved the Ninth Circuit's September 2010 ruling that computer software purchasers were not actually owners of the software, but merely licensees, and therefore not permitted to resell their copies of the software.
