Law360, New York (October 03, 2011, 3:29 PM ET) -- A New York federal jury on Monday sided with Merck & Co. Inc. in a bellwether case in multidistrict litigation alleging Fosamax causes jaw deterioration — the fourth jury to do so in litigation over the osteoporosis drug.
It was the third time the drug company won a bellwether case in the MDL over the osteoporosis drug, and the fourth case in which a jury found for Merck. The verdict came after a judge dismissed every claim but one in the Florida plaintiff's suit.
