National Union Gets Silgan's $5.8M Coverage Suit Canned

Law360, New York (October 4, 2011, 7:02 PM EDT) -- A California federal judge ruled Monday that National Union Fire Insurance Co. of Pittsburgh, Pa., did not have to cover $5.8 million in damages Silgan Containers LLC suffered when tomato cans it made for Del Monte Foods failed.

Del Monte destroyed entire inventories of canned tomato products in 2005 and 2006 after some of the Silgan cans were found to be corroding, swelling or otherwise breaking down, causing discoloration and a metallic taste in the tomatoes, according to the suit. The food company charged Silgan for...
