Bid To Nix Hospital Antitrust Suit Is DOA In High Court

Law360, New York (October 4, 2011, 6:19 PM EDT) -- The U.S. Supreme Court refused Monday to hear the University of Pittsburgh Medical Center and health insurer Highmark Inc.'s bid to nix an antitrust suit from UPMC rival West Penn Allegheny Health System Inc.

The justices declined twin petitions for writs of certiorari from UPMC and Highmark without comment, despite the defendants' claims that the Third Circuit's November decision to revive West Penn's Sherman Act suit contradicted both Supreme Court precedent and rulings by other circuit courts.
