FCC Seeks To Dismiss Verizon’s Internet Rules Case

Law360, San Diego (October 5, 2011, 3:58 PM EDT) -- The Federal Communications Commission on Wednesday asked the D.C. Circuit to throw out Verizon Communications Inc.’s challenge of the agency’s controversial net neutrality rules set to take effect next month.

The FCC contends that the appeals court has exclusive jurisdiction over agency decisions that modify individual radio licenses, but that because its December order adopting the rules did not modify radio licenses, Verizon lacks jurisdiction and the case should be dismissed.
