ITC To Probe Openwave's Claims Against Apple, RIM

Law360, New York (October 7, 2011, 9:13 PM EDT) -- The U.S. International Trade Commission said Friday it would investigate Openwave Systems Inc.'s allegations that Apple Inc. and Research In Motion Ltd. have imported iPhones, BlackBerrys and other devices that violate several patents covering mobile Internet access technology.

The ITC said it had voted to institute a Section 337 investigation based on Openwave’s Aug. 31 complaint, which mirrors a suit the Redwood City, Calif.-based company has pending over the same patents in Delaware federal court.
