FTC Speeds Approval Process For Divestiture Order Tweaks

Law360, New York (October 07, 2011, 3:02 PM ET) -- The Federal Trade Commission said Friday it was amending its rules to make it easier for parties to secure agency approval for minor contract changes on divestiture orders in merger reviews, waiving the requirement for a full commission vote.

Final amendments to the FTC's rules of practice establish a procedure parties can use to waive the requirement that the full commission vote on any divestiture contract modifications, as long as the proposed alterations do not diminish the effectiveness of the underlying FTC order.
