The Year So Far In FTAIA

Law360, New York (October 14, 2011, 12:54 PM ET) -- Congress enacted the Foreign Trade Antitrust Improvements Act of 1982, 15 U.S.C. § 6a (“FTAIA”), in 1982 with the stated goal of clarifying the extent to which United States antitrust laws apply to foreign or international transactions.

The FTAIA provides, in part, that the Sherman Act “shall not apply to conduct involving trade or commerce (other than import trade or import commerce) with foreign nations unless (1) such conduct has a direct, substantial and reasonably foreseeable effect ...
