Employers Suing Workers Shouldn't Pay Costs: Calif. Court

Law360, New York (October 12, 2011, 8:04 PM EDT) -- A California appeals court on Wednesday ruled that when an employer brings suit against its own employee and loses, the state’s labor laws do not require that employer to reimburse the prevailing worker’s defense costs.

A three-judge panel for California's Fourth District Court of Appeal affirmed the Superior Court of Orange County’s ruling that Nicholas Laboratories LLC did not have to pay the attorneys' fees its former employee, Christopher Chen, incurred in successfully defending himself in a suit the company lodged against him.
