8th Circ. Probes Plaintiffs' Standing In Health Law Suit

Law360, New York (October 20, 2011, 5:52 PM EDT) -- In one of many fronts in the battle over health care reform, the Eighth Circuit on Thursday grilled a lawyer representing Missouri residents over whether they have standing to challenge the overhaul's so-called individual mandate.

Missouri Lt. Gov. Peter Kinder and 21-year-old uninsured state resident Samantha Hill are fighting a district judge's decision dismissing the challenge and finding they had not shown that the mandate that individuals buy insurance or pay a penalty by 2014 had injured them.
