Del. May Eclipse Texas As Top Patent Venue Under AIA

Law360, New York (October 28, 2011, 2:00 PM EDT) -- The new patent law's limits on multidefendant infringement suits could hasten the long-predicted decline of the Eastern District of Texas as a popular venue for patent cases and shift the spotlight to Delaware, attorneys say.

The America Invents Act, enacted in September, contains a provision mandating that accused patent infringers may be joined as defendants in one action only if the suit alleges that the parties are jointly responsible or the claims arise "out of the same transaction (or) occurrence."
