Pfizer Wins Attys' Fees From Teva In Viagra Patent Row

Law360, New York (October 18, 2011, 1:22 PM ET) -- A Virginia federal judge on Monday granted Pfizer Inc. nearly $380,000 in attorneys' fees from Teva Pharmaceuticals USA Inc., ruling that the generics manufacturer pursued baseless inequitable conduct claims in a Viagra patent dispute.

Echoing her August decision rejecting Teva's efforts to invalidate the method-of-use patent, U.S. District Judge Rebecca Beach Smith ruled that in light of the Federal Circuit's recent Therasense ruling, the company had no basis for its allegation that one of Pfizer's attorneys failed to turn over certain information to the U.S. Patent...
