Law360, New York (October 26, 2011, 1:08 PM ET) -- In a much-anticipated decision, Texas’ highest court has ruled that “claims against workers' compensation insurers for unfair settlement practices may not be made under the [Texas] Insurance Code.”
The case, Texas Mutual Insurance Co. v. Ruttiger, No. 08-0751, — S.W.3d —, No. 08-751 (Tex. Aug. 26, 2011), was originally filed in 2005 and has, with much anticipation, been working its way through Texas’ lower courts for the past six years.
