Case Study: TianRui V. ITC

Law360, New York (October 27, 2011, 12:04 PM ET) -- On Oct. 11, 2011, a three-judge panel of the U.S. Court of Appeals for the Federal Circuit, in a 2-1 decision, issued an opinion affirming a decision of the U.S. International Trade Commission barring importation of a product made in China by a Chinese company using trade secrets allegedly misappropriated by Chinese employees in China. The trade secrets were licensed by a U.S. company to a Chinese company and were not being practiced in the United States by the U.S. company.
