Custom Software Not Covered By Consumer Law: NJ Court

Law360, New York (October 24, 2011, 7:46 PM EDT) -- A New Jersey appeals court ruled Friday that the state's Consumer Fraud Act does not apply to the customized software program at the center of a contract dispute between Princeton Healthcare System and Netsmart New York Inc.

The computer system that Princeton Healthcare hired Netsmart to provide was not available to the general public, the court ruled, a requirement for a claim under the CFA.
