9th Circ. Revives Rio Tinto Human Rights Suit

Law360, New York (October 25, 2011, 6:09 PM EDT) -- The Ninth Circuit on Tuesday breathed new life into a massive human rights class action accusing Rio Tinto PLC of contributing to a civil war in Papua New Guinea following a conflict between the mining giant and residents over alleged exposure to toxins from a mine.

In a published en banc decision, the appeals court reversed a lower court's dismissal of genocide and war crimes claims under the Alien Tort Claims Act, while affirming the dismissal of crimes against humanity and racial discrimination.
