Developer Survives Axis Bombing Range Suit For Now

Law360, New York (October 27, 2011, 3:22 PM EDT) -- A Florida federal judge on Wednesday dismissed Axis Specialty Insurance Co.'s coverage suit against a developer over class actions related to homes built near an allegedly contaminated military bombing range, but gave the insurer room to replead its claims.

Homeowners in a planned community filed the underlying proposed class actions against American Newland Communities LP and affiliates, claiming the developer failed to notify them about a nearby former bombing range allegedly contaminated with lead, mercury, nitroglycerin and other toxic chemicals.
