7th Circ. Quashes Rose Acre's Antitrust MDL Coverage Suit

Law360, New York (November 1, 2011, 6:50 PM EDT) -- The Seventh Circuit on Tuesday upheld an Indiana federal court ruling against egg producer Rose Acre Farms Inc., which accused two insurers of denying it defense coverage in a price-fixing multidistrict litigation against Rose Acre and other egg producers.

A three-judge panel affirmed U.S. District Judge Sarah Evans Barker’s February decision rejecting Rose Acre’s argument that insurers Columbia Casualty Co. and National Fire Insurance Co. of Hartford owed it coverage under their policies’ advertising liability provisions.
