24 Hour Fitness OT Class Action Sent To Arbitration

Law360, Los Angeles (November 01, 2011, 6:37 PM ET) -- A Florida federal judge on Tuesday ordered a personal trainer who brought a putative class action against 24 Hour Fitness USA Inc. for allegedly failing to pay overtime to resolve his claim by binding arbitration.

“It is undisputed that plaintiff’s claim falls within the scope of the defendant’s arbitration of disputes policy,” U.S. District Judge James L. King wrote in an order Tuesday. “[S]ince plaintiff voluntarily agreed to submit any employment-related disputes to arbitration and the present matter is an employment-related dispute, arbitration shall be required.”...
