Law360, New York (November 02, 2011, 2:11 PM ET) -- A California federal judge on Tuesday refused to toss a proposed class action accusing Safeway Inc. of overcharging customers for groceries purchased online, indicating he was leaning toward the plaintiff's reading of a service contract.
U.S. District Judge Jeffrey S. White denied Safeway's motion to dismiss plaintiff Michael Rodman's claims for breach of contract and violation of California's False Advertising Law, Unfair Competition Law and Consumers Legal Remedies Act.
