Law360, New York (November 02, 2011, 3:01 PM ET) -- A New Jersey federal judge on Monday tossed a proposed class action accusing Mercedes-Benz USA LLC of hiding an engine defect from car owners in order to avoid paying for repairs, ruling the plaintiffs had not shown the company had advance knowledge of the problem.
In an unpublished opinion, U.S. District Judge Dennis M. Cavanaugh granted the carmaker's motion to dismiss three Mercedes-Benz owners' claims for breach of express warranty, breach of implied warranty of merchantability and unjust enrichment, as well as fraud and tort allegations....
