Law360, Chicago (November 02, 2011, 3:44 PM ET) -- An attorney for FedEx Corp. asked the Seventh Circuit on Wednesday to toss a $66 million jury verdict in ATA Airlines Inc.'s suit alleging FedEx unfairly kicked it out of a government contract bidding arrangement and effectively pushed it into bankruptcy.
At oral arguments, J. Timothy Eaton of Shefsky & Froelich Ltd. told the panel that there was no enforceable contract that the parties signed for the relevant time period, and that the suit “never should have gone to a jury.”
